The defendant’s CU-BASED offerings included no-fee securities and placement-based securities, which included those based on agreements allowing either party to terminate the contracts and retake the credit without charge.

The SEC alleged that the defendant’s statements about the quality of the earnings streams from CU-BASED securities were materially false and misleading. The SEC asserted that the defendant failed to disclose that the earnings streams from the no-fee and placement-based securities were not guaranteed and that, in many cases, tuition fees collected from students for the duration of the contracts far exceeded the guaranteed amounts. The SEC also alleged that the defendant failed to disclose that the earnings streams from the no-fee and placement-based securities were subject to a number of uncertainties and risks, including the likelihood that few students would be able to complete, and therefore not earn, the guaranteed amounts on time.

Artists & Co. Make Way for New Store in Underwood Village

Two businesses in Oneida County are expanding, and they’re looking to bring in more customers to their stores.

Artists & Co., the store known for its music memorabilia, is opening a second location in Williamsville, while Trinity Candle Company is opening its first mall shop in West Seneca.

What’s common among those two new businesses is that they can keep their original businesses alive and well, while providing something else for local customers to browse for.

“We have the full store at the Williamsville location, plus we have the entertainers’ corner at the Williamsville location, so you can get both of our locations in your community,” said Diana Cefalo, director of operations at Artists & Co.

Cefalo said the new store, which will be built in the same location as the current store, has been in the works for some time. The first location opened in Syracuse in the 1980s, and it’s been in Catskill since the 1990s. The current store has 2,400 square feet of space, and the new store will have approximately 4,000 square feet. The original Williamsville store has 1,200 square feet.

“The original store was a storefront location,” Cefalo said. “Over the years, we’ve gotten a little larger, and with our main store now being 35,000 square feet, we wanted to create a separate location that would be for our music customers only.”

She said that’s why Artists & Co. is opening its newest location in the food court in the VFW building on Hutton Street in Williamsville, which is attached to the new Circle K and United Dairy Farmers stores.

Cefalo said the new store is set to open in the next few months. She said the store will offer a wider range of products than the original store, which offered mainly music items.

“We’ve had customers come in and tell us what they want, and we’re giving them an outlet for what we have,” Cefalo said. “We’ve heard from them that they want more graphic novel items and more figurines. We�
